Prescription drug abuse has become both a national and Florida problem. In 2010, Florida’s drug czar Bruce Grant was quoted as saying the prescription drug epidemic was the single greatest challenge to the state’s public health and safety. Since it was initiated in September of 2011, millions of prescription records have been entered into the Florida Prescription Drug Monitoring Program. Prescription drug abuse falls on the Chapter 893 (Drug Abuse Prevention and Control) of the Florida Statutes. Except as specifically authorized by this chapter, it is unlawful to sell, manufacture, deliver, possess with intent to sell a controlled substance. Depending upon the substance involved and other factors, charges could be a felony of the first, second or third degree. The minimal charge is a misdemeanor of the first degree. Punishment may include imprisonment from one to 30 years.
Under Florida statutes all controlled substances and listed chemicals (Contraband) are subject to seizure and confiscation. And in addition, any vessel, vehicle, aircraft, or drug paraphernalia which is used in violation may be seized and forfeited as provided by the Florida Contraband Forfeiture Act. This act includes real property, money, negotiable instruments, securities and other things of value.
